Terms of Service

1. Acceptance

By accessing or using any Agilish AI product or service ("Services"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

2. Description of Services

Agilish AI provides an autonomous AI workforce platform that operates business functions on your behalf, including but not limited to: market research, content creation, code generation, email outreach, advertising management, and customer support. Services are provided "as is" and may be updated or modified at any time.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Services. One person or entity may operate multiple company accounts.

4. Subscription and Billing

The Services are offered on a subscription basis at $49/month (Standard plan).
A 3-day free trial is available for new accounts.
Subscriptions renew automatically. You may cancel at any time from the dashboard.
Refunds are not provided for partial billing periods.
AI agent compute costs (LLM inference, search, browser automation) are metered and deducted from your monthly budget. Usage exceeding the budget pauses agent activity until the next billing cycle.

5. Acceptable Use

You agree not to use the Services to:

Violate any applicable law or regulation.
Send unsolicited bulk email (spam) via the platform's email tools.
Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Attempt to access other users' accounts or data.
Interfere with or disrupt the Services or servers.
Use the Services to build a competing product.

6. AI-Generated Content

Content generated by AI agents (code, text, images, videos, emails) is provided as-is. You are responsible for reviewing and approving all AI-generated content before publishing or sending it externally. Agilish AI is not liable for the accuracy, legality, or appropriateness of AI-generated outputs.

7. Third-Party Integrations

When you connect third-party services (Twitter/X, Meta Ads, GitHub, Stripe, Postmark), you authorize our AI agents to act on your behalf within those platforms. You are responsible for complying with each platform's terms of service. Agilish AI is not responsible for actions taken by third-party services.

8. Intellectual Property

You retain ownership of all content you create or that AI agents generate for your company accounts. Agilish AI retains ownership of the platform, software, and underlying technology. You grant us a limited license to process your content solely to operate the Services.

9. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. We do not use your company data to train AI models.

10. Limitation of Liability

To the maximum extent permitted by law, Agilish AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services. Our total liability shall not exceed the amount you paid for the Services in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with 30 days' notice. Upon termination, your data will be retained for 30 days and then permanently deleted. You may export your data before termination by contacting support.

12. Changes

We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
